Default Name Used Following Parent's Divorce and Remarriage Doesn't Match Birth Certificate

My question involves name change laws in the State of: Ohio

Through a divorce and re-marriage, last name was changed from A to B. There is a court order through a divorce where the court ruled the father would allow the last name change from A to B The B/C was never changed. Social Security info was changed to reflect the last name change. After that court ruling the parent initiated changes in all other facets of life OTHER than the B/C.

Years ago it wasn't difficult to get ID/License however those days are long gone. What court would have that order mentioned and used by the parent those 35+ years ago. Luckily have relocated to original county these documents would reside. Have a state issued License with the B last name, not the A listed on B/C How can this be sorted out? Birth father is said to be alive but I have never had any contact. He would probably know little about this name change business.

The parent who did it has offered ZERO assistance, so I am on my own. This is an issue I'd like to deal with once and for all!

Default Re: Name Was Assumed As a Child Not Matching Ohio B/C

That would be your county's family court.

I suggest you make a personal visit to the records section and have a search done for your parents' divorce case file.

Once you have located the divorce decree and the name change document (could be the same document) get several certified copies and keep them in your permanent files.

You aren't likely to be able to get your birth certificate changed without a court order but the documentation allowing the change from A to B should be enough to justify a "common law" name change, especially now that you've been an adult using the name B all these years.

There really isn't anything to sort out but if you want something official to set your mind to rest, the Ohio adult name change process is rather simple and it'll get you a court order acknowledging that your name is officially changed from A to B and could allow you to amend your birth certificate as well.

    See:

You can get a form like that from your own county Probate Court or create one on your computer with your local court's information.
