    Default Can Protective Services Tell You Who You Can Date or Marry

    If you have a protective services case due to past drug use, but are in recovery, can CPS tell you who you can date or marry? This is in Michigan. If you start a relationship with somebody who has a domestic violence PPO against him, can CPS tell you that the person cannot be around your children? Can they keep that restriction in place even if you marry the person?

    The case worker can tell you what action CPS will take if you choose to violate its instructions, whether through a new petition or during a review of your case. If you start a relationship with somebody who has a history of domestic violence, that's a valid cause for concern. If you choose to ignore their instruction, it will ultimately be the judge in your case who makes a decision, but you can expect at best that the judge will look skeptically upon your choices, and at worst that the judge will either affirm the position of CPS that this person is a potential danger to your child or that you are demonstrating a pattern of failure to protect your child that justifies either the continued supervision of your case, the placement of your children outside of your home, or (if in effect) the continuation of an out-of-home placement.
