    Default Foreclosing Against a Property With a Deceased Owner

    When a property is in foreclosure, but one of the co-owners has passed away, how does the lender proceed with foreclosure against that owner?

    If an estate is open, the lender can serve the estate. If an estate was processed and closed, but the property was somehow overlooked, the lender can re-open the estate and serve the estate. If no estate has ever been opened, the lender may open an estate and serve the estate.
