    Default Should You Sign Papers Admitting to Shoplifting

    If you're caught shoplifting in a store and they tell you that if you sign papers they'll let you go with a civil demand and a trespass ban, should you sign the papers? If they decide to prosecute you, can the papers be used against you in court? If you don't sign the papers, are you still banned from going back to the store?

    If they're telling you, "Sign and we won't prosecute, or don't sign and we'll call the police," then you need to weigh your options based upon your knowledge of your actions and the evidence that the store possesses.

    If you are told, "You are banned from the store", then you are banned even if you sign nothing.

    If you sign a confession, it is possible that the prosecutor might try to use the confession in court if you're later prosecuted. There may be arguments against its admission into evidence, and you would discuss that with your lawyer.
