    Question Rental With No Written Agreement in California

    I own a condo in California. My roommate told me she was giving me 30 days notice on January 13th (moved out around the 21st). We do not have a written agreement, but discussed doing month to month ($700/month) before she moved in. Nobody has moved into her room as of yet. She has paid $700 for security deposit. I looked on the CA Consumers Affair webpage (website below) and was wondering if the 30 days notice applies to me as well even though there was no written agreement. I haven't spoken with her yet, but believe she will say that since she moved out in January she won't have to pay any February rent. Am I correct in assuming that I can charge her rent until February 12th? If so then how do I split that up for February? ($700/28 days)x12 days?

    How long did she live with you? During that time she paid rent on a monthly basis?

    Thanks for replying Mr. Knowitall. Yes, she has paid on the 1st of the month since mid 2005.

    I see on the Consumers Affairs document that I had linked in the original post that the "tenant who wants to end a periodic tenancy must give the landlord the same amount of written notice as there are days between rent payments."

    Since she gave me notice on Jan. 13th. Can still charge her for the extra days in February since I have not found another roommate yet. I understand that if I do find a roommate before Feb. 12th I'll owe her for the days that the roommate moved in.

    I am unclear about the verbal agreement laws in California. Does the Consumer Affairs document apply even without a written agreement?

    Yes, it's a periodic tenancy and she is supposed to give proper notice.
