    Default Marrying a J-1 Visa Holder

    A U.S. citizen wants to marry a J1 visa holder. Her visa does not indicate that the two year HRR applies to her, but she's going to confirm that with the State Department and seek a waiver if necessary. She has been in the U.S. for two years. Can they marry in the U.S. when she is in J1 status, and then adjust her status?

    Assuming that the two-year HRR does not apply, yes, they can marry and petition to adjust her status based on marriage.
