    Default Caught Trespassing in New Jersey

    My question involves criminal law for the state of: New Jersey

    Okay, so a couple of my friends and I were caught trespassing today. We were driving down the road and the Owner blocked the road off so we would not be able to leave. The cop arrived after a half an hour of waiting. I was the only 18 year old of the group(I had just turned 18 and they were 17). The cop wrote our names down and took our licences to his car(Everyone there, even took mine and i wasn't driving). He basically told us to leave after and something about a court date, but didnt give us more info to the matter. What should i expect going into court? Am i going to get a felony charge? Something on my record? I literally turned 18 a week ago......

    Given that you have told us nothing about what happened, other than that you were trespassing, we're in a poor position to comment on theoretical charges or sentences. But yes, if you commit a crime, you can expect the charge and any conviction that follows to end up on your criminal record.

    Depending on the facts, trespass charges under N.J.S.A. Sec. 2C:18-3 may potentially be classified as a disorderly persons offense, a petty disorderly persons offense, or a crime of the fourth degree.

    It will be charged as a Disorderly Person. It will show on your criminal record. You should hire an attorney and see if the DP charge can be downgraded to a municipal ordinance, this charge will not show up on a criminal record search.

    Since you were not driving, you could say that you were taken to a restricted area against your will.

    Seriously?? Your advice is for OP to accuse his 17 year old friends, in open court, of felony kidnapping? In order to avoid consequences on a petty trespassing charge? Glad I don't have "friends" like you!
