    Default Medical Travel Before Going to Court on a Shoplifting Charge

    My question involves criminal law for the state of: ohio

    hi all,
    iam so ashamed n frustrated n humiliated abt the recent shoplifting incident in meijer ,oh ,it was a clouded judgement n a bad choice of what i did n got caught....i had actually shopped in mny other storesb4 i got to meijer n realized was on a crunch n since my pending trip was cmg up kind of felt desperate n a unwise move to go for it..iam a first time shoplifter n have never been in a situation like this pls help...

    i had purchased 2 item s n had concealed several items in the bag..for which the LP guys approached after exiting the store n took me to the back office n questioned me abt the thgs in the bag n identity n pic of me,value of the items n told i would receive papers of civil demand compensations n fine n they would further go for court n may expect summons..what options do i have to have reduced charges of shop lifting? is diversion program eligible for me ,iam 35 yrs of age...and how do i get the criminal record or charges off my history..iam unemployed presently? will it effect future applications? they didnt mke me sign on anythg..but took pics n collected evidence..
    also i had amedical emrgency procedure cmg up ,scheduled n would have to travel to my home country,but i didnt receive any paper work yet,is it advisable to travel out of country for medical procedures? n also worried ,will i b able to meet the court dates in case,they take it further...or is there anyother way to meet the court requirements...pls explain the consequences,time taken for these n what can i expect n how to plea in court,,i hv ahad sleepless nights n abt attorney fees and abt how i should proceed n whether to travel or not or how should i get the reducced charges n criminal charges off the record,pls suggest asa p...Thanks in advance

    Dude, proper punctuation, and spelling is your friend. You're not texting us. You're 35 not 16 (and I wouldn't even take this from a teenager).

    You can definitely expect a letter from Meijer's "lawyers" demanding the civil restitution. I can't even decipher what followed after that in your message. If the police or prosecutor call you, decline to speak to them without a lawyer. You are currently free to travel. If you receive papers from the state charging you with a crime, you need an attorney. Make sure you inform him of your medical/travel issues and your immigration status if you are not a US citizen.

    LP will often threaten you with paying the civil demand OR else they'll prosecute. The usual fact is that if they didn't report this to the police at the time it happened, nobody is going to do so later when the civil demand paperwork comes flying.

    Yes,iam willing to rectify and do the needful as per law ,iam a green card holder,not a citizen yet.....,Iam35,a female and made a bad choice in that moment.. really not in right state of mind n stressed and probably would face the worst consequences now ,scared enough..

    LP didnt make me sign on anythg,,talked to me about civil demand and fines ,which they didnt tell much and can be expected in the mail,i was wondering how long do they take for that ? but with their conversation,i heard them ,they would prosecute n were collecting evidence,idi ed me,took pics and value of the merchandise came upto 219 or so without tax n stuff..didnt share much information with me..after that..

    here police were called in and asked them about certain details,value of the merchandise n items n a court order possibly.. they gave me a sheet of civil demand rights paper with sme 800 number and not much paper work was given to me..so how long does it take for such court order to process? in case they have decided to go for it?

    since i have travel plans, i am asking about the rough time usually officials take for a civil demand or a court order in general? if so ihave to reschedule or cancel ...my plans..

    or is it advisable at all to travel out of country when u r amidst all of this n no papers nor charges in hand ? since my medical travel plans r a little uncertain,it may delay or finsh early..so my confusions..and was supposed to travel this weekend itself..

    will i be in trouble while travelling out of country,to answer any questions w immigrations or airports,worried what to answer incase i travel amidst this charges?

    most importantly,whats the consequences of my case,due to my age n crime,am i eligible for any adult diversion program. in oh?this is the first ever n the last ofcourse...what options do i have?

    how do i get reduced charges in case iam prosecuted for criminal charges?

    i dont want it as a permanent record in my history? what do i do for it?

    iam currently unemployed ..n worried about my future applications n credits and stuff..and loans..will it have an effect on that?

    Right now ,they told me to expect the papers in mail by coming monday and incident happened on a wednesday..

    Worried, what r the consequences? if i have a court order ,how should i plea? what are my options n to proceed ,causing no further damage?

    how long do the court proceeding take ? And what should i prepare myself with?

    When and if you receive the charges, contact a lawyer. Let him know of your immigration status. A conviction for this can have serious implications if you ever intend to naturalize. There will be multiple court appearances before this is all over. If you are indigent and can not afford an attorney, ask at the outset for a public defender.

    iam not due for citizenship yet...atleast for few more years...what kind of effects do i have in future?

    how much does a public defender cost versus a lawyer? and ho can i approach one?

    i have heard of diversion programs and expungement laws ,can i not use these in my case and make avail of it?

    how much time does these programs take to complete or laws to come into effect?

    Nothing is going to hide your conviction from the government regarding your theft. Although in the legal realm you may be a first time offender, I guarantee you this is NOT the first time you've stolen something. No one starts with $200+ items for their first offense.

    Believe it or not..its my first and since the amount is higher ,it may have sounded like that..each item was around 40 or 30 each..and some loose items..n didnt realize at one point..!

    No. You are in this position because you are a thief who took things you wanted and for which you didn't pay. The fact that you didn't realize HOW MUCH you were stealing matters not.
