    Angry Suing Parents for a Violent Crime Committed by a Minor

    If a minor is convicted of a violent crime against another minor and the parents of the victim file suit against the parents of the convicted minor, what can the parents of the convicted minor expect? Can homeowner's insurance defend/settle?

    What is the name of your state?

    Also the ages of the children and what happened?

    California Law. both minor are 16 and there is little proof of injury or any long term physical impairment. Mostly psychological. Appears to be a fishing expedition at this point

    You could possibly be liable for up to $10,000 for each incident in a personal injury case that was caused by an assault by your 16 year old.


    Can homeowner's insurance defend/settle?
    Policies vary, this is something you will have to check in to. Some policies will cover the costs that result from a minor's acts, however, it usually is limited and typically covers negligent acts not intentional. Also because of the age of your minor child you may have been covered if you would have obtained an additional rider for situations such as this.

    So, IMO, with the limited facts that you provided, I don't believe it will be covered.

    You should check with your insurance provider though, and it would be wise to consult with an attorney.

    There could be an attempt to create a negligent supervision claim, which if raised would likely be covered by homeowners insurance.
