Hello there. I was convicted of assault and did 120 days jail time with one year of supervision. Its been 10 months into the probation period without an issue. I have had six different PO officers during this time frame, and each would generally go over everything again, then I never saw them again.
A condition of my probation is employment or education. My wife and I purchased a house, and I have been renovating it while preparing to go back to college in the winter quarter of this year.
The previous five probation officers said that was great, and never mentioned anything, but my most recent one said that while working on the house and preparing for college was great, it doesn't count at all for the requirement of employment or education. I asked her why none of the other officers told me about this, and she responded by turning the monitor, pointing to the condition and saying " I didn't make this up " which didn't answer my question at all.
During this interview, my old PO walked past, said hello, mentioned how he would visit and see all the work I had done on the house, and - then she cut him off and restated how it didn't count.
I asked her, " Well I appreciate you telling me this I thought I was in compliance based on the response from my other POs during the last 10 months, but I am concerned about a violation, what should I be doing now? "
She told me to seek employment or get into school immediately. I am doing so now, applying to places, logging the information and waiting while also trying to get into school sooner (probably wont happen because fall quarter started already)
Should I be worried about a violation hearing considering I have been technically unemployed the last 10 months even though I was told by every other officer what I was doing was perfectly fine?
Or just try to find work, log the information and report back and consider myself safe for the next two months?
