    Default Who is Liable for Personal Property Damage After an Apartment Floods

    If an upstairs tenant leaves the water running, causing a flood of the downstairs unit, who is liable for water damage to the downstairs tenant's personal property? The landlord is cleaning up the water and performing any necessary repairs to the apartment, but is taking no responsibility for the downstairs tenant's belongings.

    The landlord has no liability for the independent, negligent acts of a tenant, so the person to pursue for any property damage is the tenant who caused the flooding. Ideally a tenant will cary renter's insurance such that their exposure for this type of damage is limited to the deductible they choose under their policy, with the potential of trying to recover the deductible from the negligent tenant.
