    Default Unlawful Entry of a Home

    Two neighbors got into an argument. One went into his home. The other followed him in, without an invitation. The first neighbor then pushed him out, toward the door. Can the neighbor who entered be charged with a crime for entering the home without permission? Can the homeowner be charged with assault for pushing the intruding neighbor?

    If they called the police and one or both of them were charged, that's your answer. If they didn't call the police, odds are nobody is going to press charges.

    As for what charges might hypothetically be filed, that will depend upon state law and the full facts of what happened.
