    Default Liability for HOA Dues After Bankruptcy

    If you declare bankruptcy, give up your home, and then go through a Chapter 13 repayment plan, can you be held liable for HOA dues and fees that accrued after you filed bankruptcy? The HOA was included in the bankruptcy as a creditor.

    It sounds like the problem here is that the lender didn't foreclose on the home, and thus that HOA dues continued to accrue in the name of the debtor, post-filing. If that's the case, the fees are probably enforceable. The debtors should discuss the fees with their bankruptcy lawyer.
