    Default Eligibility for Public Assistance After Adjudication is Withheld on a Drug Charge

    In Florida, if a recipient of disability benefits and food assistance receives adjudication withheld for simple possession of marijuana, will that disposition affect their eligibility for benefits?

    The disposition should not affect your benefits. If you complete the deferral you won't have a conviction, let alone a felony conviction; and even a conviction for misdemeanor drug possession won't affect your benefits. Florida had a drug program to test TANF recipients for the use of drugs, with a positive test potentially affecting benefits, but last I heard that program had been suspended by the courts.
