    Default Have to back out of seller contract - husband won't sign non-homestead affidavit

    I am about to file for divorce and I was trying to sell my sole and separate property. I consulted an attorney before signing the seller's contract - he said it would be fine. The title company has now indicated they will not issue a title policy unless my husband signs an affidavit of non-homestead - and he won't. He also plans to contest the divorce. I am afraid the buyers will sue me. Any thoughts?

    File for divorce ASAP, and bring a motion to authorize the sale. Get help from a lawyer.
