    Default Can You Sue a Borrower's Spouse Over a Loan

    In California, if you get a judgment against a person who borrows money from you and they do not pay, can you use community property laws to recover the money from their spouse?

    It may be possible to collect the money from joint assets, such as a joint bank account, but the spouse is not directly liable and thus you're not going to be able to attach the spouse's separate assets or garnish their pay.
