Default What to Do if the At-Fault Driver Doesn't Cooperate With an Insurance Claim

If somebody damages your car in an accident and you make a claim with their insurance, what can you do if they don't cooperate with their insurance company's investigation of the claim? The insurance company says that it can dismiss the claim based upon the client's non-cooperation.

If you have collision coverage you can make a claim through your own insurance company and let them deal with the other issues when trying to subrogate.

You can also sue the at-fault driver, something that might cause them to recognize that it is in their best interest to cooperate with the settlement of the claim.
