    Default Dischargeability of a Restitution Judgment Against a Disabled Defendant

    A few years ago I was convicted of vandalism, and was ordered to pay a great deal of money as restitution. Shortly after my conviction, while on probation, I was diagnosed as disabled and have since been receiving SSI. I was unable to pay my restitution, and when I was discharged from probation it was converted to a money judgment. Can I get the judgment discharged in bankruptcy?

    No, you cannot discharge the debt, at least if the court is made aware of the facts, as the judgment arises from an intentionally committed crime. However, if you're on SSI you're effectively uncollectable, and eventually the judgment will expire.
