    Default What is the Punishment for Damage to Property

    My question involves criminal law for the state of: Wisconsin

    My fiancé was charged with Damage of Property. The Type: Forf. U Statute: 39.35(A) of Sauk County. Police arrested him and told him he had a warrant out for his arrest (We were an hour away from Sauk County where we both live) which both of us were surprised about. I wasn't there, but heard from his friend. Its super important to me to figure out how long until i'm seeing him again and I've done a lot of research and didn't find what I wanted. Please help!!

    The Sauk County ordinance for damage to property is Sec. 11.04.
    Quote Quoting Sauk County Ordinances, Sec. 11.15. Penalty.
    The penalty for violating any section of this chapter shall be a forfeiture of not less than ten dollars ($10.00) nor more than one thousand dollars ($1,000.00) together with court costs and fees prescribed by §§ 814.63(1) and (2) Stats., penalty assessment imposed by § 165.87 Stats., jail assessment imposed by § 53.46(1) Stats. and automation fee imposed by § 814.635 Stats.

    So he is most definitely getting a fine, but he shouldn't be more than 9 months im pretty sure.

    No jail time is possible. Wisconsin has three kinds of offenses: felonies, misdemeanors, and forfeitures (other states would likely call them infractions/violations). Forfeitures in Wisconsin do not carry any possibility of jail time; just merely a fine (and points on a driving record, if applicable).
