    Default How to Divorce Somebody Who is in Prison

    My question involves a marriage in the state of: Kentucky

    How can I get a divorce from my husband if he's in prison and I haven't seen him or talked to him in 3 years?

    I'm going to assume that you want to file for divorce without a lawyer. There are forms and instructions here.

    Contact the prison facility in which your husband is incarcerated. Ask about their procedure for service of process upon an inmate. They will be able to tell you how to serve the divorce lawsuit upon your husband.

    Once he is served, the case will proceed in the court in which it is filed. Your husband may default, or he may agree to enter a consent judgment. Sometimes a prison inmate will choose to fight a legal case in the hope that he'll be transported to courts for hearings, and get a break from prison life; I can't promise whether your husband will cooperate or be a squeaky wheel.
