    Default How Long Does CPS Maintain its Records

    So iv been trying to obtain my records now for over a year records reguarding both my childern as well as my records from when i was a child they lost my records request once and the second time i requested them it took over 9 months to get. Now im being told my juinivel records were destroyed since they cant seem to find them. Dont they have a time frame they r required to keep them? And dont they than have to have a log of some sort saying files were destroyed

    You did not mention in what state these records would be located and that matters because if there is any law that requires the records be held for a certain period of time that would be state law — the federal government does not regulate record retention requirements for most state agency records. The chances are, though, that any records from when you were a child are well past whatever time requirement might exist.

    thank you for pointing that out and for your response, shouldn't they have some sort of log telling them records were destroyed and when it was done?

    Not necessarily, again, they would only have something like a log if state law required them to have one.

    How old are the records you seek?

    What is the nature of the records you seek? Understand that they may be under no requirement to provide you with ANY records?

    You are looking for CPS records from when YOU were a child, AND regarding your children? This seems ... ominous.

    Oregon does not have a statute that specifies how long the agency must keep the records so far as I can determine. However, the Oregon Department of Human Services does have a set policy on how long it will retain these records. The length of time depends on the outcome of the child protective case.     But the record retention policy may have been much different years ago when you were a kid, so it is possible that the records would have been destroyed much earlier back then even if the records would still be kept today if the present schedule had been in effect back then.
