@Geek, this is why I have asked how do I get the judge to ORDER the repairs here and I wish someone could simply answer.
Both repair requests have expired, nothing has been done by him to remedy his situation.
I cannot file an escrow (that is out of the question at this time) or an abatement until 14 days after the repair request which has not been acted upon.
Now is the next step, I can goto court and... I am not exactly sure yet how or what... get the COURT to order this.
By doing this I enhance my case of abatement against him as the court would want me to do.
Then THEY get some money see statute 504b.391 next, they are really respecting me and I do a bit better come my day in the abatement court and I get MY money.
No?
Sure, he has scammed me out of an operable door, if there is a fire I may roast and die like I am in hell. and other things.
Seemingly at this point the eviction and repair orders are two different things, the repair order still stands. I do not see any type of deadline on me after the landlord does not do as asked. Me, having been evicted or not.
The court case did not encompass the repair orders, therefore how does an eviction expire my repair request?
I do not see how they could even consider twisting things like that. repair requests can (and mine does) encompass some serious and dangerous items.
I gave him a nice little list of things to get in order in case his next renter is not such a nice guy and as patient as I was.
He could had done something about that side door with the puddle of mud, will he care if mud is being tracked into his house? Well it is.
I no longer will bend over backwards with him.
New post coming up, something just occured to me...
thanks geek!
