    Default What Can You Do if a Magistrate's Findings are Unfair

    My question involves a marriage in the state of: Florida The magistrate assigned to my contested divorce heard an emergency hearing and several things in his report are not true or accurate as to my testimony at the hearing. I can not afford the transcripts required to file exception to the magistrate report. Is there anything else i can do? Or do I just have to take the injustice because of my financial status won't allow me to defend mine or our children's rights?

    Pretty much, unless you can figure out how to properly file an appeal with a higher court within the deadline without an attorney.

    He can't file an appeal .. he first has to file objections to the judge of the magistrate's decision. He can file indigency and request the transcripts be provided at state expense.

    agreed,if the judge agrees the magistrate is right he then go's to a higher court
