    Default Can the Police Give a Breathalyzer to a Minor at a Party

    My question involves criminal law for the state of: Pennsylvania....If a minor who is not driving at a party where it gets busted by the State Police, and the minor has been drinking, are the State Police allowed to breathalize the minor without parental consent?

    Yes, they can. However, a 2009 court decision states they can't use PBT results in court. So they either have to give you a regular calibrated breath test or administer field sobriety tests (or both).
