    Default Fraud by False Representation

    Hello

    Okay, so to sum everything up as best as I can. Three years ago my brother made a mistake and was charged for Fraud by False Representation for a figure he took from a company he once worked for in the region of £20k, he was 20 at this time and they dealt with it at the Magistrates Court where I got 18 Weeks in a young offenders. I did only end up serving 5 Weeks plus the remainder on an electronic tag.

    However three years later he has messed up again! He is heart broken that he has let everyone down again and done a similar thing but this time to another company. This said he hasn't been arrested yet! However he did admit it last week and 3 days later they dismissed him and the police are performing an investigation. He knows the figure will be around 10k this time however as I say he admitted it and did ask if I could resolve it without involving the police. However they have. He still has not heard from the police however it is only of days before we do and he hasn't told our parents yet, and truthfully even I am scared for them to know! It broke our family last time and I know it will kill them this time so I cant bare to tell them myself and nor can he. However what sort of sentence could he expect this time? he admits he wants all the help he can get. He will plead guilty and admit everything however would they still deal with it at Magistrates? He does realise what he has have done and as I say he does want all the help he can get to sort his life out, he is 23 now just in case I forgot to mention. I am so scared of what will happen so I just want a rough idea what he can expect. As the amount is half what it was last time, could he just expect a similar sentence as it is second offence and could they just deal with it at Magistrates.

    There is no help.

    He's a two time criminal crapping in his pants at the thought of going to GAOL as they say in your country.

    I dont disagree but surely you have a better response then that? I am looking for genuine advise on the likely outcome

    My thought was if he had 18 weeks previously and that occassion the amount was double this time then perhaps would be half that? However as it is a second offense then it could be the same as last time?

    US law and UK law is not the same, and we have no experts on UK law here. We cannot possible guess what the results might be.
