    Question Demands for Repayment of Money Given as Gifts

    My question involves collection proceedings in the State of: Florida
    During hard financial times my ex Sister-in-law gave me money on several occasions to help financially. Two years later, after my wife and I divorced, I receive a demand letter for me to repay the money or she will sue me in small claims court in Florida. There was never any written agreement for repayment, and I'm sure if my ex and I were still married, this would never be an issue. Can she do this? Someone please advise.

    No, and nothing was ever said about repayment. There were never any repayment arrangements made. This has to do with them being mad because my ex and I divorced, nothing more.

    Well, she can sue you, but whether she wins or not? Because this will be a "he said she said" situation, we can't say more than you have a 50/50 chance of prevailing.

    Maybe more of a "he said, she said, she said" situation if the ex-wife testifies along with the sister that there was an agreement to repay the loan.

    I don't know how much credibility the judge would apply to the two sisters' testimony, maybe some. Without some documentation, maybe none.
