I had a chapter 7 BK in 2004. Most accounts were reporting the info correctly.
November 2006 I pull my credit report and see that in Feb 06 capital one started reporting a 2004 discharged account as 90 days past due.
I called cap one and told them of the error. The updated it incorrectly and it now says for that account included in BK on nov 06. I have sent c&d letters cmrrr to capital one, and I have disputed it with the CRA. The CRA came back as updated and left the info the same, and capital one has yet to respond to my letters demanding deletion. I am thinking of sending cap one one more letter and if this does not work will I have enough to sue them for the innaccuracies and unwillingness to fix them? I just sent another dispute out to the CRA after I was sure capital one recieved my letter stating the account was incorrect, will this give me enough for "willful" if they continue to update it with the CRA after I have informed them of the error? If I can sue, what is the best venue? Thks Chris from Michigan
