    Default Problems With a Veneer After a Dental Procedure

    My question involves malpractice in the state of: California, here is my story

    I initially contacted this Dentist to get my wisdom tooth taken care of. My first visit was on 3/07/16, which was the day of the extraction, following with a deep cleaning and a checkup on 3/14/16. There was an assessment for more dental work at the time of the deep cleaning, including three resin replacements (which are very sensitive to cold and hot), and one being a crown located in my lower right back side. I was scheduled to get the crown procedure on 4/1/16. During the procedure everything seemed to be fine until we got to the finishing part; I needed to bite the articulating paper and grind my teeth. I thought it a little strange because a few times she needed to trim my upper teeth, yet the new crown was located on my lower teeth. When the work was done I returned home, but once the anesthesia wore off I felt that my bite was a bit off.

    I thought it was a matter of adjusting my bite or just getting used to the new crown, but a few days passed and I was feeling the same. I called to schedule an appointment and managed to see the dentist a couple of days after. In the meantime, I was trying to be more careful because I bit my tongue a couple of times while eating. While waiting to see the doctor I woke up one morning and I noticed my front veneer cracked in half. This was frustrating because I had to deal with both a cracked veneer and an uneven crown. When I went to see the dentist I explained in detail what the issues were and she proceeded to use the articulating paper asking me to grind my teeth. However, after a couple of attempts, I mentioned that it felt the same. She tried again. This time I grinded my teeth back and forth and that was when she realized it was really high and continued trimming until it felt much better. I mentioned at that time that my veneer broke in half and I thought it was due to the uneven bite, but she made no comments about it. Instead she mentioned that the veneer was aesthetic and might not be covered by my insurance. As a quick fix, she mentioned that she would only do a patch-up for the moment. She then explained the cost and how I was going to pay almost half. She also mentioned that I did not have money left on my ADP FSA account (which I verified later and it was not accurate) and that I had to wait until next year to be able to use it.

    Overall, I was appalled because there was no empathy at all towards the pain I felt and the issue at hand. With her, it seemed as though it was all about money, and I left without a solution to my problem which was obviously caused by the uneven crown. I went home low-spirited by the negligence and the avoidance of my problem, but after talking to friends and family, I realized that I should not be responsible for the cost of replacing my veneer caused by the uneven crown. After a couple of weeks of thinking about it, I decided to call the dentist and explain how I felt about the unfairness of the situation due to the fact that I would have to pay for repairing the veneer out-of-pocket. After explaining in detail how it happened, she agreed and was even apologetic. She told me she was going to call me back to let me know how this issue would be handled. Two days later, her receptionist called me and said that I had two choices: either to pay in full right away so that I could get this done quickly, or to wait for the insurance approval and pay around $800 out-of-pocket. I was disappointed to hear those conditions and I told her that I was not going to choose either option because I did not feel at fault. I asked to speak with the dentist but she was not available. I asked the receptionist to have her call me but she never did.

    A week later, the receptionist called me but the options were the same so I declined. It has been 2 weeks and I have not heard from them. At this point, I do not want to have any more work done by this particular dentist. I only want my veneer to be replaced. Now my question is should i take this to small claims? My veneer was paid out of packet 5 years ago in Tijuana Mexico will this be a problem if i decided to move forward with this? should I get all the paperwork from the dentist in tijuana? please help ?

    You were given options for treatment by the dentist. You rejected the options. If you have changed your mind, you can go back to the dentist and see if the options will again be made available, or you can go to another dentist.

    You have given absolutely no evidence that would suggest that the dentist is responsible for the fact that your veneer wore out. Obviously, no amount of trimming on your upper teeth would have affected a veneer on a lower tooth.

    Did you leave some important facts out of your story?
