    Default Emancipation in Nevada

    I have a friend who lived and grew up with her mom in the Phillipines for 16 years. She moved to Las Vegas to live with her dad she is now 17 and has lived with him for one year. Her mom decided to send her out here for the better opportunities. Her dad and her are not seeing eye to eye and she recently lost her job and he almost hit her. She talked to her mom and she said I dont mind if you move in with Thalia (me) I live with my finace and his parents. She told her dad she wanted to leave and he siad let me talk to your mom. Well they got into a heated argument over the phone. He told her " if you insists on moving out Im taking you to the airport" He said if she leaves without telling him he is going to charge her as a runaway and he will sue whomever im statying with.He told her her mom had no say since she is in the phillipines and that she is under his care.

    She is scared to stay there all he does is yell. Is there anypaper work her mom can sign even though she doesnt live here giving her permission to leave or emancipation papers? She will be 18 but not until September. What is the best way going about this?

    This is not an emancipation situation. (see below)

    NRS 129.080 Minor may petition juvenile court for decree of emancipation; reference to master. Any minor who is at least 16 years of age, who is married or living apart from his parents or legal guardian, and who is a resident of the county, may petition the juvenile court of that county for a decree of emancipation. The district court may refer the petition to a master appointed pursuant to title 5 of NRS or chapter 432B of NRS.



    NRS 129.090 Petition: Contents; fees.

    1. A petition filed pursuant to NRS 129.080 must be in writing, verified by the petitioner and set forth:

    (a) The name, age and address of the minor;

    (b) The names and addresses of the parents of the minor;

    (c) The name and address of any legal guardian of the minor;

    (d) If no parent or guardian can be found, the name and address of the child’s nearest known relative residing within this state;

    (e) Facts relating to the minor’s education, employment, and length of residence apart from his parents or guardian;

    (f) That the minor willingly lives apart from his parents or legal guardian with the consent or acquiescence of his parents or legal guardian;

    (g) That the minor is managing his own financial affairs;

    (h) That the source of the minor’s income is not derived from any activity declared to be a crime by the laws of this state or the United States; and

    (i) That the minor is attending school or has been excused from attending school pursuant to NRS 392.040 to 392.125, inclusive.

    2. If any of the facts required by subsection 1 are not known, the petition must so state.

    3. For filing the petition, the clerk of the district court shall charge the fees prescribed by law for the commencement of civil actions or proceedings generally.
    She should talk with a school counselor about the problems she is having at home. Anybody "harboring a runaway" could be charged criminally.

    She graduated already in the phillipines.

    So if this is not an emancipation situation, how does she go about moving out with only one parent approval...If she has a job is tha all she needs and as long as she has a place to stay? I am sorry i have never dealt with a situation like this.

    She can try to move out, have dad treat her as a runaway, and see what happens. Or she can move back to the Philippines.
