    Lightbulb Can You Qualify for Unemployment After Recovering from a Disability

    My question involves labor and employment law for the state of: California.

    Hello!

    I quit my job because I was sick and my job exacerbated my condition, but I did so without a doctor's recommendation. After I quit, I applied for unemployment and was rejected (because I quit due to illness). Then, I saw a doctor and was put on disability. I'm no longer disabled, and I'm actively looking for work. Am I eligible for unemployment now even though I wasn't eligible when I first applied?

    Depends on WHY you were denied.

    Once you did that and a decision was rendered, and you didn't appeal it, it became final.

    If you were denied because you quit without good cause, then you can't get UI now. You don't get to get a denial, and then have the same separation adjudicated a second time, and that's what you're trying to do since you never worked again since you quit that job.

    If you were denied because you were found not "able and available," for work, then you can REopen our claim and submit your doctor's statement that you're cured, and you should have no trouble getting UI.

    Regardless, go ahead and try. Sometimes mistakes get made in your favor or maybe there was more to the decision than you can understand and communicate. It's not like it takes that much time to fill out the online application.

    Chyvan should also know that a great deal will depend on how long you were out on disability. Depending on how long you were out of work, you may or may not have had sufficient wage contributions to be eligible.

    Absolutely go ahead an apply. No one ever qualified for benefits by not applying for them. Just be aware that there is more than one prong to the eligibility fork.
