    Default Who is Responsible to Pay For Major Repairs on a Lease With an Option to Buy

    My question involves landlord-tenant law in the State of: Utah

    I am currently renting a home, with an option to buy. We have given the owners $15,000 towards the down payment and are currently living in the home.

    Two weeks after we moved in, there was a major rain storm and the basement flooded multiple time. The current owners are out of country and so we emailed them to ask what to do to repair the damage.
    Long story....but because of the water damage, more problems were found (mold and foundation problems). The owners repaired the damage. I have not seen the bills, but it was reported to be around $20,000.

    Now, one year later, the owners are asking for us to reimburse them because of an as-is clause in the lease contract that addresses rain damage.
    We have not yet purchased the home, but are in the process of getting that completed now.

    What are our rights? We don't own it yet, and we do not want them to back out of the purchase if we won't pay for the repairs.

    You will need to show your contract to a real estate lawyer, then discuss the detailed facts of your situation with your lawyer. The landlord/seller made the repairs, so they fulfilled their obligations as a landlord, but you may well have agreed to pay those costs in the event that you purchase the property.

    Thanks. We have consulted a lawyer and they want to do more research and charge me to do that. I get that part, I was just hoping not to have to pay for that too.
