My question involves landlord-tenant law in the State of: Utah
I am currently renting a home, with an option to buy. We have given the owners $15,000 towards the down payment and are currently living in the home.
Two weeks after we moved in, there was a major rain storm and the basement flooded multiple time. The current owners are out of country and so we emailed them to ask what to do to repair the damage.
Long story....but because of the water damage, more problems were found (mold and foundation problems). The owners repaired the damage. I have not seen the bills, but it was reported to be around $20,000.
Now, one year later, the owners are asking for us to reimburse them because of an as-is clause in the lease contract that addresses rain damage.
We have not yet purchased the home, but are in the process of getting that completed now.
What are our rights? We don't own it yet, and we do not want them to back out of the purchase if we won't pay for the repairs.
