    Default Statute of Limitations for traffic accidents in the State of Vermont

    My Husband was involved in a traffic accident in 5/2006 in Vermont. To this day he has not been charged as at fault. I have contacted the district attorney to see if was a planning on charging him. His response was it is still open and under investigagtion. There were minor injuries but no fatalities. I would like to know how long they have before they can no longer charge him. there was no ticket written at the time of the accident.

    Why do you believe he would be criminally charged, and what offense do you believe would be charged?

    Failure to stay right. He was not cited at the time of the accident. At the time the investigating officer stated that he crossed the center line but did not follow through with any kind of citation or warning. We later found out that she sent the file to the district attorney for criminal charges. When I spoke with him back in October he stated he told the investigating officer to find a professional that would be able to say who was at fault for sure. To this day we have not heard anything. I want to have this matter dropped because my husband was fired from his job over this. That is why I need to know how long after an accident can you be citied as at fault.

    You can be charged until the criminal statute of limitations expires, which in Vermont appears to be three years for misdemeanors and longer, depending upon the offense charged, for more serious offenses. You can be sued until the civil statute of limitations expires.
