    Default Safety Inspection Requirements for a Gravel Dump Truck

    My question is does Kentucky require Gravel Dump Trucks to pass A safety inspection

    I had a small building destroyed by a runaway old gravel single axle dump truck. The truck stalled on a hill and when the driver tried to restart the motor it did not start and he had no hydraulic power brakes and crashed into building destroying it.

    I doubt it was hydraulic brakes. Hydraulic brakes while they may be assisted are powered by the foot jamming the pedal. What I suspect (and would be most common) is that the service air brakes ran out of air though I'm not sure why the emergency brake wouldn't have worked.

    What does having a safety inspection have to do with your claim?

    I was told by someone who knows truck, that the brakes were power hydraulic and when truck didn't start he had no brakes. If the law requires trucks to be inspected and it wasn't, it is my thought it might be considered more serious that just an accident. No one has come forward to claim responsibility.

    It sounds like they are responsible whether the truck was inspected or not. You should have the identity of the driver and the company he works for and insurance do you not? Have you tried to submit a claim?

    Company owner has said he might furnish information but has not. I am told by Sheriff Department that tomorrow after 7:00 am I can talk to a clerk and get information from an accident report I requested. I hope they have something that will place blame. I am 250 miles away from property.

    After three calls today to Sheriff Department, I got a call from Deputy that said he was going out to investigate the accident I had requested a report on last Sat.. He said when he got there the truck was gone and several people on golf carts were there and they told him all was fine, and the company had made arrangements to repair building. Since this was not true I asked if he was going to find out what happened. He said Sat July 23 he would go back out and see if he could find out anything. I asked if he did find truck could he check to see if it met safety requirements. He said he had no way of knowing.

    The question I have now is, how do I get information required to file a claim. Since this is a well liked contractor in the subdivision I don't think any will swear who did it. I can get the names but have no way of proving it.

    Hydraulic brakes in a truck are just like power brakes in a car. If a cars motor isn't running, you need to push down hard on the brakes to stop the car, just like you would need to push down hard on the brakes of that truck to stop it. If a truck has air brakes and the air leaks out, spring brakes apply pressure to the shoes that will stop the truck. So the truck had brakes no matter if the motor was stalled or not.
