    Default H-1B extension with dismissed criminal record

    Hello Everybody! I hate to interrupt you but I have to. Thanks a lot in advance.

    I'm currently a H-1B visa holder and planing to apply H-1B visa extension in US. However, one problem concerns me a lot. I was arrested, more pricisely, I received a citation and then asked to give the fingerprints around a month later, and charged with shoplifting for something less than 10 dollars. I plea no gulity and the charge was dismissed/withdrawn with the help of my attoney. And I was told there is no record after expungment.

    However, I was told recently that the record will always saved in somewhere and immigration officers are able to see it. My question is that how this case would affect my H-1B visa extension, green card applicaton and visa stamp application outside US.

    Information on Pennsylvania expungements, their effect and how to confirm that an expungement was granted, can be found on the Allegheny Courts website.

    You will likely be asked to detail encounters with the police when filling out certain immigration forms, or possibly during an interview. You need to be honest in your answers to those inquiries, as being caught making a false statement can have significant consequences. Given that you did not enter a guilty plea and were not prosecuted, even if the USCIS learned of the incident the consequence of the incident should be minimal as you did not confess to a criminal act and have no conviction from the incident.
