I finally was able to talk to someone at the law firm and they told me that as of today they've received $1575 dollars from us and the balance is $4551.93
They also said I could make a lump sum offer and they will either accept, reject or make a counteroffer and I'll have 10 days to come up with the money.
I also talked to a credit counseling service and they told me I should hire a lawyer and it's possible that for a few hundred dollars they could write a letter to the court and make this go away based on what we've paid so far based on the idea that the 45% interest could be constitute usury in this state. Not really buying that because we do owe them some money still in my opinion and it just sounds too easy.
SO here's my question, now that we all have more information how would you proceed if you were dumb enough to get into this situation?
This is what I'm thinking.
Original loan including fees and insurances. $2900
Amount paid so far ...................................$1575
Offer $1500 and hope they come back under $2500
Does that sound reasonable? Thanks again. I appreciate all of your responses. You've been a great help.
OH and one more thing, the lady I talked to at the lawyer's office didn't flat out say I shouldn't hire a lawyer but tried to make the case by telling me it would be even more expenses. You gotta love it.
I'll be over hereuntil I get my wife's mess cleaned up.....
