    Default Can a 17-Year-Old Go on an Overnight Trip Against Her Parents' Wishes

    My question involves juvenile law in the State of: Illinois

    Can a 17 year old can go on an overnight trip without their parents consent? Or if they go and are back within 24 hours, can they get in trouble for it?

    A 17 year-old is still a minor and subject to his/her parent’s control. The minor certainly may get “in trouble for it” with his/her parents if the minor goes on the trip without consent.

    How so? What kind of serious trouble could result for them? They are not kidnapping the kid or otherwise forcing him/her to go, after all. Nor are they harboring a runaway or in any way keeping the kid from his parents. Absent some kind of restraining order or injunction in place I don’t see any “serious trouble” for those adults other than the kid’s parents may not like those adults anymore, may refuse to have anything to with them, and may refuse to let their kid have anything to do with them. I do not see any legal consequences for them, however. You seem to assume that the adults even know the kid is not allowed to go. While it would be a good idea for the adults to ask the kid’s parents directly if the kid is allowed to go, no law in any state I’m familiar with has a law requiring that.

    Why is this an issue for you? What's happening to you? Did your parents say no? Did you go anyway and get grounded (or something) when you got back? What is it you really want to know?

    As a former responder on these forums used to say, 17 is not 18 lite. Your parents have complete say over you until you are 18. Not 17, 18. Will you go to jail for going on an overnight trip without permission? No. Can your parents punish you and make your life miserable if you go on an overnight trip without permission? Damn straight they can.

    No TV.
    No cell phone.
    No driving - and Mom drives you to school every day and drops you off in front of all your friends and picks you up every afternoon, or just puts you on the big yellow school bus with all the other CHILDREN.

    No door to your room.
    No computer except for school, and that only under supervision.
    No going anywhere but school and, if applicable, your appropriate house of worship.
    No nothin' but school and home until Mom and Dad decide you can be trusted again. Or until you turn 18 and move out on your own.

    If sex is involved and he is older, he could get into a lot of legal trouble.

    I’m not sure why you brought up the idea of sex being involved, nothing remotely suggesting sex was planned was mentioned by the OP, nor was anything even said about the make up of the people going on the overnight stay. But even assuming sex did take place, if it occurred in Illinois and both persons consented, there would be no legal trouble here for the OP’s partner because the age of consent in Illinois is age 17.
