    Red face Do You Have to Pay Back TANF Benefits from SSI Back Pay

    I was just given a fully favorable decision by the ALJ. I have been receiving TANF and food stamps for the last 2 years. My question is, once I receive my SSI backpay, do I have to repay the state for the TANF and food stamps that I have been received? I am looking at about 22 months of backpay. I have been searching on Google for this answer, but have found both yes and no. I am just wondering what to expect. Thanks!

    Your share of the TANF grant is considered income to you in the months you received. SSI, Supplemental Security Income ALWAYS uses other income sources in computing payments, including TANF grants. Your share of the grant is considered to be the difference between the grant amount with you on the grant and the grant amount with you off the grant.

    So, no, you don't have to pay back the TANF, but since the first S in SSI stands for Supplemental, when you have 'other' income, you need less supplemental income.

    Many types of other income are factored into SSI payments; pensions, unemployment, private or public disability, worker's comp, wages, gifts, inheritances, gambling winnings, insurance settlements, Social Security benefits. As a general rule, any other income can affect SSI. There are a few exceptions but TANF is not one of them. When the SSI is paid, your share of the TANF should stop, and you will have to let SSI know that your TANF share is now zero so SSI can stop counting it.

    Food stamps do not count as income.

    Some states deduct cash assistance that the state has paid from SSI backpay only. If you were receiving cash assistance in the same months that you will receive back pay for, your state may take what they paid you. This does not apply to any children, only you.
