    Default CIMT and Visa Eligibility

    So i was caught shoplifting about 5 years ago and the officer did not arrest or charge me for this offense. Instead he gave me a non criminal ticket for tresspassing which i paid. So the question comes here.. am i still inadmissible for a visa since i did commit a Crime involving moral turpitude even though i wasn't charged/arrested for it? thanks.

    Of course you committed a crime of moral turpitude. You were just lucky enough not to be prosecuted, and thus haven't been convicted of the crime you committed.

    Shoplifting offenses usually fall under the petty offense exception for immigration purposes, so even if the USCIS figures out that the trespassing ticket reflects a shoplifting incident, that alone shouldn't disqualify you for a visa.
