    Default Failed to do community service and charged again

    SF, California- My boyfriend was arrested last year for grand theft over $400 (487(A) PC). He was charged with a misdemeanor and got community service. However, he did not do the community service and he was recently arrested for possession of a controlled substance (11377 HS) and possession of burglary tools (466 PC). His hearing is tomorrow and I want to know how the failure to do his community service will affect him, as he is being charged again with his crime of theft from last year. So, that makes it two misdemeanors and one felony (possession of substance). Can he get off without jail time? Keep in mind, the amount possessed was under a gram and the burglary tools were a key and a multitool swiss army type thing.

    Probation does not work for him.

    The only alternative is jail.

    He violated the conditions (or at least one of them) of probation the alternative is he serve out whatever sentence he got. Exmaple he got 3o days in jail but was suspended pending successful probabtion then he would do 30 days now judge could add time for violation as well! Based on your post seems like your BF is not going to stop getting in trouble. Now might be a good time to reconsider your relationship and what future if any there is in it!

    He's not making it easy for the judge to give him a break. If he has not done so already, he should obtain representation by a criminal defense lawyer.

    Wouldn't having a lawyer give him a negative connotation of being overly defensive in court? It was my understanding that sometimes having a lawyer can be a bad choice, as it can be viewed negatively by the judge.

    No judges prefer defendants have proper legal counsel
