    Default Can You Claim Ownership of Land on Your Side of a Fence, That You Historically Mow

    My question involves real estate located in the State of: New York
    So we have lived in this house for 15 years. We have mowed a part of our back yard that entire time. There was a fence up so we assumed it our property. Even when the fence was gone we mowed it the neighbor had no problem. When she moved out and sold it to somebody else after a few months some disputes broke out, we were still cutting that portion of yard. The new neighbor put a fence up where the old one was. So that portion of yard is on our side. I want to know since we have been cutting it for so long and they put a fence so it's on our side do we own it/ are able to cut it and have small things like wood storage on it?

    Have you now determined that it is not in fact your property? If so, when and how did you make that determination?

    How much is the area of land worth? Is it worth spending thousands of dollars to formalize a claim to the land, when you appear to already have full use and enjoyment without that investment?

    Do you have structures/functions built on the land? Merely cutting the grass normally doesn't do it, esp. in NY where the laws around posssession seem tighter than they are here in TX at least. Not a lawyer, just dealt with AP case here and had a friend face it in upstate NY.
