    Question When to Request Discovery on Your Traffic Ticket

    My question involves a traffic ticket from the state of: Washington (King County)

    It's over 30 days until my court date and I wanted to understand when the best time is to request Discovery in hopes they don't give it to me within 7 days of the court date. If I file it now, I'm thinking that gives them plenty of time to get through their cumbersome process to mail it to me. If I file it shortly before 14 days, that might mean they are late in sending it out. But I wanted to find out what is recommended.

    From a tactical standpoint, no. Tactically, the best possible moment for Washington courts is exactly 14 days to the trial, and preferably hand delivered/filed. The idea is to give the prosecutor's office the least possible number of days to respond.

    Yeah, sure, lots of people decide that they want to play games, and games often bite them in the posterior -- for example, if they make a mistake in the content of their demand or with the service of their demand.

    It is not playing games to comply with discovery rules. Why give the prosecutor more time than legally required to respond? A properly written demand has everything required if one uses the template that Barry wrote up. It is almost impossible to make a mistake if you use it.

    It is gamesmanship to wait until the last second to file a discovery request in what will likely be a vain effort to trip up the prosecutor. The fact that it's permitted by the rules does not mean you're not playing a game.

    Seeking discovery at the last moment also gives you less time to prepare your own case based upon discovery materials, and can potentially undermine a claim of prejudice if there is for some reason a late response. As Mr. K indicated, it can also hoist the defendant by his own petard if he fails to submit a proper discovery request, even if a defendant who does his homework could get it right.
