    Default Do I Need a Lawyer to Change My Daughter's Last Name

    My question involves name change laws in the State of: Mississippi

    I am getting married next month. I have a child with my fiance and an older child from a previous relationship. I have full custody of my daughter, my ex was abusive and also has an extensive criminal record. I had a 5 year restraining order against him when we first split up, which was when my daughter was just 2 months old. She has absolutely no relationship with him and he hasn't seen her since then. He tried taking me to court a couple times, most recently about 3 years ago, but because of his history I have full custody and he has never had visitation. My youngest daughter has my fiance's last name so we also want to change my older daughter's last name as well so we can all have the same last name. She currently has my last name which she was given at birth with my ex's consent. We talked to a lawyer and they recommend us having one to complete the name change because of my issues with my ex, but it is very costly and I'm just wondering if it would be possible to do it ourselves and what the process would be. Any help or advice is appreciated.

    Here's the thing. She never had Dad's name - correct? So he isn't going to lose anything when it comes down to brass tacks. Just be prepared to offer a compromise if the court leaves it up for mediation; First name Dad'sname-Yourmarriedname. You may not need to do it, but having a reasonable suggestion never hurt anyone.

    Of course, there's always the suggestion that the rest of you change names to match older Daughter's.

    Unless a court has stripped him of his parental rights you will need you ex's consent or you will have to convince a judge that it is the best interest of the child. That's the tough part but you don't need a lawyer to do it.

    Google Mississippi Name Change for a Minor and you'll come up with guides, forms and instructions.

    If you don't succeed your daughter is not too young to learn that life can sometimes be unkind and one doesn't always get what one wants.
