    Default Can You Still be Charged With Shoplifitng if You Put the Item Back

    My question involves criminal law for the state of: Florida

    I went into Walmart on my way home from work to grab some food and stopped by the toy aisle to see if anything new was out for the upcoming birthdays. I found a cool keychain, grabbed it, went to the next aisle over and took it out of the package and popped it in my pocket. As I turned around to leave the aisle I saw there was a camera kinda hidden against the aisle's shelf, like a little tablet, showing that it was recording and what it was recording. Of course I instantly got scared and guilty because I just realized I'm an adult stealing a stupid toy keychain. I go to the next aisle to think and cool off then return to the aisle where the camera was and put the keychain back in the package and put it down. I know the camera had a good shot of me and my work uniform so it wouldn't be hard for them to email someone at my job and ask if they know my face to get info on me. I know it was stupid and hate that I did it, and honestly feel like crap about it and it's eating me up. I did put it back though so I didn't leave with it. Do you think Walmart will go through the trouble of getting my info and serve me a civil fine or something? I don't wanna lose my job or get demoted after finally getting the promotion I worked so hard for.

    I highly doubt WallyWorld will go through a lot of trouble for an open keychain. They will probably write it off to a kid messing with it or someone trying to steal it then changing their mind.

    Stop trying to steal stuff.

    I agree with Free9Man. If this is an isolated incident, chances are they're not going to be chasing down the video. Walmart has TONS of cameras (every checkout lane has them as well as other strategic locations). However, they tend to look at them only when they determine issues after the fact. Finding a shrinkage small item in the store isn't likely to send them on a fishing expedition.

    Stop stealing. Stay out of that particular Walmart for a while. If contacted by the police, decline to speak with them without an attorney.

    I hope so, but I know this camera tablet was new to the toy aisle and the other aisles didn't have one installed. And it was on a motion sensor so it only recorded when someone got about halfway down the aisle. Hopefully they just write it off since it was so small, but yeah this helped me realize I need to keep my clepto hands on the cart....

    It's possible they are having a problem with theft of other merchandise occurring in that aisle so they installed the camera to monitor that. Although if it's that easily spotted, I'd wonder if it isn't just some kind of dummy to spook people.

    Again, they aren't really going to waste time on an attempted theft.
