    Default What is Reasonable "Pain and Suffering" Settlement for an Auto Accident Case

    My question involves an injury that occurred in the state of:

    Nevada


    I am about to enter settlement negotiation due to a car accident that sent me
    to the ER.

    I was picked up by an ambulance and taken to ER for a few hours to be checked
    out - I was diagnosed with a "chest contusion" due to my seat belt.

    At the time of the car accident, I was recovering from heart surgery. The accident
    set my recovery time back approximately 2 months, causing me additional chest
    pain.

    The insurance settlement is offering me $5k for my pain and suffering, and I am
    questioning what a reasonable settlement would be. Any feedback is greatly
    appreciated.

    You haven't provided much information but two months is about right for recovering from any aches and pains from an auto accident even if you hadn't have had heart surgery.

    $5000 for two months pain and suffering is reasonable.

    If that's the insurance company's first offer and you haven't talked money before that, try countering with $7500 and see if they'll meet in the middle. It's a small claim, the claim rep probably has room to negotiate and would like to see a small claim closed and gone.

    If he won't budge, then it's up to you.
