    Default Getting Emancipated Without Parents Consent

    So, I know I have a problem here. I want to know if I can be emancipated, though I live in the state of Kansas where the law to be emancipated is 16. I have just turned 16, and I am on probation. But before you stop reading because of that, lets talk about why I'm on probation. I have gotten arrested three times for things I didn't do. The first time was a battery charge and long story short my dad pulled me by my hair a threw me across the room and he started hitting me. It escalated from him slapping me to him full on punching me. The cops said that it was okay that he hit me, but the fact that I hit him back out of self defense was "wrong." The second time I was arrested, my mom head butted me and had given me a black eye. Of course after that, I would have wanted to leave the house and not be around her. But as soon as I walked out of the door to go on a walk she screamed "if you leave, I'll call the cops and tell them that you hit me!" I never did that. I almost ran away that day because of that. I got drunk and came home (I know it was a bad idea to go and get drunk.) I got arrested for battery and MIP. When I should have only gotten the MIP charge. The last time I got arrested, was because my sister beat me with a frying pan and blamed it on me and told my dad that I was crazy and should have me arrested for it. So I was arrested for aggravated battery and was held in custody for a week. My parents are literally insane. They scream at me for wanting to have friends over. And cops are at our house every week. My parents always threaten to get me "locked up." Even though they don't have anything to call them for, but trust me they find their ways. They always find a way. Even if they have to start a fight to get you to hit them, they'll do it. Because they know that they won't go to jail for it and only me or my sister will. My dad once banned me from eating anything that he buys because I refused to go to Karate practice anymore. And the only reason I don't is because they use it against me whenever they try to get me to hit them. They always tell the cops that I am a black belt and that I know how to hurt them. And I'm not even a black belt. I'm a green belt and barely know anything. I'm 16, I haven't done any drugs or alcohol in 10 months and I don't plan on it. I'm terrified that my family is going to try to get me arrested again when I get off of probation. Is there any way I can get emancipated without their consent? And if so, can I know all of the laws for it and stuff? Like do they have the right to say where I live? Please help. I really can't do this any longer.

    Abused minors are not emancipated. They are placed in alternate living situations. Your best bet is to either call the cops or CPS/DHR/DHS/DFC and report the abuse. You can also talk with a trusted adult (teacher, preacher, school counselor) about the situation and see if they will contact the mentioned departments.

    There is no possible way to be emancipated without parental consent, or at least parental acquiescence. And before you could be emancipated even WITH parental consent, you would have to be able to prove to the satisfaction of the judge that you were capable of paying every single cent of your own support - that means rent, utilities, food, clothing, medical care, transportation, insurance, staples, school fees and supplies, etc.

    I'm not saying there is no way for you to leave the house, but it will not be through emancipation. I agree with the above poster that you need to involve CPS and/or law enforcement.
