    Default Ticket for Impeding Normal Flow of Traffic, Minimum Speed Violation, VC 22400(A)

    My question involves a traffic ticket from the state of: California

    My son double parked to eat at a food truck because there was no parking available....stupid and illegal, I know. He left the car running and went to get his food. When he came back, a police officer had just arrived. He cited him for VC22400(a) Minimum Speed, Impeding normal flow of traffic. This is a $238 fine. It seems to me that this would be considered parking illegally...double parking...$55.

    What do you all think?

    The statute applies.

    Well, if it actually impeded any traffic, then the section was appropriately applied.

    Your son should consider it an expensive lesson.

    Double parking is covered by the below section, but because he left the car running, I would still go with VC 22400(a).

    CVC 22500.
    No person shall stop, park, or leave standing any vehicle whether attended or unattended, except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or official traffic control device, in any of the following places:

    (h) On the roadway side of any vehicle stopped, parked, or standing at the curb or edge of a highway, except for a school bus when stopped to load or unload pupils in a business or residence district where the speed limit is 25 miles per hour or less.

    And for double parking to be cited, it also has to be a violation codified by the local municipality or county. Where both the 22400 and 22500 might apply, an officer has discretion as to which they can cite.
