    Default Demand Letter for a Shoplifting Civil Demand

    My question involves court procedures for the state of: Calif.
    I recently received a demand letter from a store that I was caught shoplifting in. It states they are authorized to demand I pay damages in the amount of the retail value of the merchandise if not salable and an additional amount up to $500.00. They are demanding I pay $250.00 in 1 week. If I don't comply they have the recourse to file a civil suit. The items valued $25.00 to $30.00 and they put them back on the shelf to resale. I'm seeing a therapist due to my shoplifting conviction and I'm in recovery. I have already paid $2,000.00 in therapy. Do you think if I send them $30.00 for items or call them they will leave me alone?

    If they do sue you, even for the small amount, you may have to pay the store's attorney fees. At $300 (average) per hour you are looking at a lot more than $250.

    My advice: Pay it without arguing about it.

    Then work on straightening out your head so this doesn't happen again.
