    Default What is the Penalty for Identity Fraud

    My question involves criminal law for the state of: Ohio
    Okay so hypothetically speaking say I'm dating a woman who when she was younger was abducted and sold into prostitution and one day she managed to get away from these people. Now the hypothetical young woman in question started her life over but couldn't face her family because she felt ashamed of herself anyway fast forward to present day this hypothetical woman in question she's thinking about going to finally see her family but worries she could be facing legal ramifications as she may or may not have been living under a false name under which she may have hypothetically built a life for herself including a career. I in this hypothetical scenario as a concerned friend have come here on her behalf to learn of any potential legal ramification that may befall her.

    I would suggest - hypothetically of course - that you discuss your hypothetical storyline with a reputable ghost-writer or, perhaps (hypothetically, naturally), doing your own research instead of asking others to do it for you ... for free.

    Hypothetically, I mean.

    (Why you keep asking folk here to do your work for you, I don't know)

    There are so many hypothetical crimes that could be implicated by a lifetime of hypothetical facts, I would suggest browsing both the Ohio Code (especially the penal provision) and U.S. Code for possible offenses.

    Creating a different name for yourself is not itself illegal. After all, many actors have done just that and there is nothing illegal about having adopted a different name for their acting careers than their legal name. What matters are the details. Did she steal the identity of someone else? Did she use a different identity to commit fraud or otherwise cheat someone else? Did she lie about her identity to the government? Without knowing exactly what she did it is impossible to say what crimes, if any, she committed.

    If you are going to write crime related stories then I suggest you get used to the idea of hiring a lawyer to be your legal consultant if you lack knowledge of the law and want your stories to be reasonably close to accurate on the law. That’s what professional writers do.

    Of course, if you write fiction you can tell the story any way you want and it doesn’t have to be legally accurate. Lots of writers change things to make the story more interesting even though that means making it less accurate technically. I’ve seen loads of movies and TV shows about lawyers and court trials that are very dramatic but bear very little resemblance to the real thing. The real thing can be pretty boring to most people. So the writers livened things up at the expense of accuracy to make a better story.
