    Default My Boyfriend's Ex Destroyed My Personal Property

    My question involves personal property located in the State of: maryland
    Sorry if it's too long

    The ex of my bf basically walked into his house (unlocked ) while him and I were sleeping . She started punching me in my sleep and pulling my hair out .I did NOT hit her during the attack.he got her off of me and i left the room so she couldnt hit me and didnt come out until i was told she left the premises.while I was in the separate room she grabbed a bag of my belongings estimated to about $1100 and left.

    We attempted to get my belongings returned but she said that we better hope the trash man did not come.on the phone (call) she admitted to smashing my laptop and throwing out of things.My bag included credit cards,expensive clothing,makeup,extensions,my laptop etc.I made a police report the day of the incident .

    She is now saying she only wants to pay for the laptop and nothing else .my bf saw the attack.a friend who was also there saw her take my things while was in the separate room.and she admitted to attacking me and throwing out my things in text.I do not have receipts because I did not think this would happen so is there a way I can get her to pay for all of the things she destroyed/discarded?thank you for the help.

    There are only two ways that you can legally compel her to pay for the stolen items. The first requires that she be prosecuted and convicted, and that she be ordered to make reparations as part of the conviction or plea deal. The second requires that you sue her in Small Claims court. The burden of proof is lower in civil court, so this might be easier.

    If she thinks she can get out of being prosecuted for the attack and the theft, she might agree to pay for everything. However, beware! If the police and the prosecutor catch wind that you are negotiating for the return of your property, they may see this as no longer a criminal matter and see it as a civil issue only. So, tread carefully if you start bargaining with her.

    In short, if you intend to see that she is prosecuted, stay in touch with the police and work towards that end. If you want to negotiate your stuff back and think she'll return or pay for it, then you may have to kiss any prosecution goodbye. It's your call.

    I would just stick with the police report you issued and not negotiate with her. I would rather get her prosecuted for the attack than anything else. They will send you a victim statement from the victim witness unit that asks if there was any damage to property (if she gets charged with the attack) and how much. Then they ask if there was psychological damage and if you had to go to therapy and how much did that cost and will ask what you want to see happen with sentencing, etc.

    I agree you're more likely to get something out of the police investigation if she gets charged than if you negotiate.

    Has she been charged with anything? From your statement (and you have a witness), she should have some pretty serious charges levied against her for assault.

    You and your boyfriend certainly shouldn't be speaking with her directly at all, if she in fact entered your residence and did as you described. The police and attorneys should be.
