    Default Concerned About a Child's Well-being

    My question involves child abuse or neglect in the State of: Texas

    I babysit my nephew Monday through Friday and every day his mom come to get him at 7. Everytime he comes to my house he always has bruise marks, insect bites, rashes and scabes. He also tells me that his moms boyfriend hits him on his butt and that he touches him. In the past we have called cps on her because he had swallowed a penny and pooped right out, he spent a week bleeding from his butt and cps did nothing. He's been left alone at home before and with nothing to eat.
    Can I take him from her?

    Of course you can't.

    You call CPS again, and let them investigate - again. That is your recourse. Stealing children is not to be encouraged.

    Absolutely not. You are not a parent or guardian of the child and thus have rights to any kind of custody of the child. If you take the child and keep him away from his mother you may be charged with kidnapping or other similar offense. All you can do here is document your concerns and notify CPS if you believe the child is being abused.

    How old is the child ? How do you know he was left at home alone and with no food ? Did you go to their house and see him there alone and with no food yourself ? I doubt you did, but if you did, whu didn't you call CPS and report it while you were there ?
